2. Definitions
In these Terms:
- “Website” means the website at velmorinzol.world and all associated pages and content.
- “Customer”, “you” and “your” mean the natural or legal person who accesses the website or places an order.
- “Product” or “Products” means the goods (including Activenza and any other items) offered for sale on the website.
- “Order” means your offer to purchase Products submitted via the website and accepted by us in accordance with these Terms.
- “Consumer” means a natural person acting for purposes outside his or her trade, business, craft or profession, as defined in the Consumer Rights Act 2022 (Ireland) and EU consumer law.
3. Use of the website
You may use the website only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the website in any way that violates applicable Irish or EU law, or that could harm, disable or overburden the website or our systems.
- Attempt to gain unauthorised access to any part of the website, our systems, or the data of other users.
- Transmit any virus, malware, or other harmful or disruptive code.
- Scrape, harvest, or use automated means to collect content or data from the website without our prior written consent.
- Impersonate any person or entity or misrepresent your affiliation.
- Use the website to send unsolicited commercial communications or spam.
We reserve the right to suspend or terminate your access to the website if we reasonably believe you have breached these Terms or for operational or legal reasons. We do not guarantee that the website will be available at all times; we may modify, suspend or discontinue it (or any part of it) with or without notice where reasonable.
4. Products and information
We offer dietary supplements and related products, including Activenza, a natural complex intended to support daily vitality and inner balance. Product descriptions, images, and specifications are provided in good faith but may be subject to change (e.g. packaging or minor formulation updates). We do not guarantee that product descriptions or other content on the website are error-free, complete or current. Obvious errors in pricing or description may be corrected, and we reserve the right to refuse or cancel orders placed on the basis of such errors.
Our Products are food supplements, not medicines. They are not intended to diagnose, treat, cure or prevent any disease. You should not rely on the website content as a substitute for professional medical or nutritional advice. If you have a medical condition, are pregnant, breastfeeding, or taking medication, consult your doctor before use.
5. Orders, contract formation and price
When you submit an order via the website, you are making an offer to purchase the selected Products on these Terms. A contract between you and us is formed only when we send you an order confirmation (e.g. by email) accepting your order. We may refuse or cancel an order (e.g. due to stock, pricing error, suspected fraud, or failure to pass validation) without liability, and we will refund any payment already made in that case.
Prices displayed on the website are in euros (€) and include any applicable VAT at the rate applicable in Ireland at the time of order, unless otherwise stated. Delivery charges (if any) will be shown before you confirm the order. We reserve the right to change prices at any time; changes will not affect orders already accepted. The price you pay is the price stated at the time you place your order, subject to correction of manifest errors.
6. Payment and delivery
Payment is due as indicated during checkout. We accept the payment methods displayed on the website. You must provide accurate payment and billing details. By submitting an order, you confirm that you are authorised to use the chosen payment method. We may use third-party payment processors; their terms and privacy policies apply to the processing of your payment data. We will deliver the Products to the address you provide, within the timeframe indicated on the website or in the order confirmation, subject to availability and force majeure. Risk in the Products passes to you upon delivery. If you are a Consumer, you have the right to withdraw from the contract under the conditions set out in our Return Policy.
7. Returns, refunds and cancellation
Our Return Policy forms part of these Terms. It describes your right to cancel (withdrawal), return Products, and claim refunds where applicable under Irish and EU consumer law. Please read it before ordering. Nothing in these Terms limits your statutory rights as a Consumer.
8. Intellectual property
All content on the website (including text, graphics, logos, images, and software) is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws. You may view and download content for your personal, non-commercial use only. You may not copy, modify, distribute, or use any content for commercial purposes without our prior written consent.
9. Limitation of liability
To the fullest extent permitted by applicable law:
- We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
- We shall not be liable for any indirect, consequential, or special loss, or for loss of profit, revenue, data, or goodwill, arising from your use of the website or from the supply or use of Products, whether in contract, tort (including negligence), or otherwise.
- Our total liability to you in respect of any order or use of the website shall not exceed the amount you paid for the relevant Products in that order (or, if no payment has been made, €100).
These limitations apply whether or not we have been advised of the possibility of such loss. Because some jurisdictions do not allow the exclusion or limitation of certain liabilities, the above may not fully apply to you; in that case, our liability will be limited to the maximum extent permitted by law.
10. Privacy and data protection
Your use of the website and any order involve the processing of personal data. This is described in our Privacy Policy and Cookie Policy. By using the website and placing orders, you acknowledge that you have read and understood those policies and consent to the processing described therein where consent is required.
11. General provisions
Governing law: These Terms are governed by the laws of Ireland. The courts of Ireland have non-exclusive jurisdiction over any dispute arising from or relating to these Terms or the website, save that if you are a Consumer resident in the EU you may also benefit from mandatory consumer protection rules and may bring proceedings in your country of residence.
Severability: If any part of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Entire agreement: These Terms, together with our Privacy Policy, Cookie Policy and Return Policy (as applicable), constitute the entire agreement between you and us regarding the website and orders, and supersede any prior agreements or understandings.
Changes: We may amend these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the website or placement of orders after the changes take effect constitutes acceptance of the amended Terms. For existing orders, the Terms in force at the time of the order apply. We encourage you to review this page periodically.
